GENERAL TERMS AND CONDITIONS - Intens Fit
1. Definitions
1.1 In these terms and conditions, the following definitions shall apply:
- "Gym: Intens Fit, located at Job 1A Ens
- "Member" means any person who enters into a membership agreement with the Gym.
- "Membership" means the agreement between the Member and the Sports School regarding the use of the facilities of the Sports School.
- "Facilities" means all fitness equipment, rooms and facilities offered by the Gym.
2. Membership
2.1 Membership is entered into for a period of 1 month and can be renewed per month unless otherwise agreed upon.
2.2 Membership is strictly personal and cannot be transferred to third parties without the permission of the Gym.
2.3 The Gym reserves the right to refuse new members and to remove members in case of violation of the house rules or these general conditions.
3. Payment
3.1 Membership fees are payable monthly.
3.2 In case of late payment, membership is automatically suspended until the overdue payment is paid.
3.3 If the membership fee is not paid within the specified period, the Gym reserves the right to charge an administration fee.
4. Termination and Termination.
4.1 Termination of membership may be submitted in writing, giving one month's notice prior to the expiration date.
4.2 No refund of membership fees will be granted in case of early cancellation, unless otherwise agreed in special cases, such as medical reasons.
5. House Rules and Standards of Conduct.
5.1 All members must abide by the Gym's house rules, which are visible in the Gym and on the website.
5.2 It is mandatory to wear correct sportswear and clean sports shoes.
5.3 The use of towels during exercise is mandatory. Equipment must be left clean and dry after use.
5.4 Respectful behavior toward other members and staff is mandatory. Aggressive or indecent behavior may result in immediate termination of membership without refund.
6. Liability
6.1 The Gym is not liable for loss, damage or theft of Member's personal property.
6.2 Use of the Gym's facilities is entirely at the Member's own risk. The Gym accepts no liability for physical injury or damage caused while using the facilities.
6.3 The Gym advises members to undergo a medical examination before beginning training and to consult a professional instructor at their discretion.
7. Privacy and Data Protection
7.1 The Gym processes personal data of members in accordance with applicable privacy laws. Data will be kept confidential and used only for administrative purposes and communication.
7.2 The Member has the right to access, correct and delete his or her personal data.
8. Modification of Terms
8.1 The Gym reserves the right to modify these terms and conditions. Amended terms and conditions will be communicated to members at least 7 days prior to coming into force.
8.2 If the Member does not agree with the changes, he or she has the right to cancel the membership without further obligations.
9. Applicable Law
9.1 These general terms and conditions are governed by Dutch law.
9.2 Disputes between the Member and the Sports School are preferably resolved by mutual agreement. If this fails, disputes may be submitted to the competent court.
